Terms of Service

These terms apply between [WDDW legal name], [address], [KvK number] ("we") and the business that creates a Signal account ("you"). Signal is meant for businesses, not consumers.

1. The Service

Signal ("the Service") is software that runs on your website. It:

  • reads visits
  • asks visitors short questions
  • estimates who is ready to buy
  • offers ways to get in touch
  • shows the results in a dashboard

We may improve and change the Service. If a change takes away something you rely on, we'll tell you at least 30 days before.

2. Your account

  • You're responsible for what happens in your account and for keeping passwords safe.
  • The people you invite act on your behalf.
  • You confirm that the information you give us is correct, and that you may bind the business you sign up for.
  • You accept these terms when you sign up or join a team; we record which version you accepted and when.

3. Plans, trial and payment

  • Trial: your first project starts a free 14-day trial with the Growth plan's limits. We don't ask for a card.

  • Plans: the plans, prices and limits are on our pricing page:

    • visitors per month
    • websites
    • team members

    Prices exclude VAT. Monthly plans are paid in advance each month. Yearly plans are paid in advance each year and cost ten months.

  • Payment runs through Stripe. By choosing a plan, you allow us to charge the payment method you give Stripe until you cancel.

  • Limits: if a month's visitors go above 110% of your plan, or your trial or paid plan ends, Signal pauses. It stops asking questions and showing offers until the next month or a plan change, but keeps recording visits and forms. We email you at 80% and 100%, when Signal pauses, and three days before a trial ends. We never charge more than your plan without your consent.

  • Price changes: we'll announce them at least 30 days before they take effect. They start at your next billing period.

  • Cancelling: you can cancel at any time in Manage billing. The plan runs until the end of the paid period; we don't refund partial periods, except where the law requires it.

  • Failed payments: if a payment fails, Stripe retries. If it still fails, we may pause the Service after telling you.

4. Your data and your visitors

  • Your data is yours. You own your content and the data about your visitors. We use it only to provide the Service, as described in our Data Processing Agreement, which is part of these terms.
  • You're the controller for your visitors' data. You're responsible for:
    • telling your visitors about Signal (see our consent guide)
    • not putting personal data into "facts" (traits) or free-text trait questions, which Signal passes to its judgment model
    • getting consent where the law requires it
    • having a lawful basis to contact the people who become leads
  • We don't sell your data, use it for other customers, or use it to train AI models.
  • When your account ends, you can export your data first. You can delete a project, or your whole account, yourself in the dashboard; it's removed at once. Deleting your account cancels a running plan straight away, without a refund for the rest of the period. Stripe keeps invoices as the law requires.

5. Acceptable use

You may not use Signal to:

  • break the law or others' rights
  • collect sensitive data (health, religion, etc.) through its questions or forms
  • track people across other websites
  • send spam
  • attack or overload the Service
  • resell it without our written permission

We may suspend an account that breaks these rules, after a warning unless the matter is urgent.

6. Availability and support

We aim for high availability but don't guarantee uninterrupted service. We plan maintenance for quiet hours where we can. Support is by email: [support@domain]. [Paid plans: an answer within 2 working days.]

7. Liability

  • The Service's judgments are estimates. Decisions you take based on them are yours.
  • Our total liability per year is limited to the fees you paid us in the 12 months before the claim.
  • We're not liable for indirect damage, such as lost profit, lost revenue or lost data, beyond what we must restore.
  • These limits don't apply to intent or gross negligence.

8. Intellectual property

The Service, its software and its designs belong to us. You get the right to use them during your subscription. Feedback you give us may be used to improve the Service.

9. Ending the agreement

  • Cancelling: see §3. We may end the agreement with 30 days' notice.
  • Serious breach: either side may end it straight away if the other seriously breaches it and doesn't put that right within 14 days of notice.

10. General

  • Dutch law applies. Disputes go to the competent court in [Amsterdam / the court of our registered office].
  • If one clause is invalid, the rest still applies.
  • We may change these terms with 30 days' notice for existing customers; continuing to use Signal after that means you accept them.
